In an usual ruling, an Ohio Appeals Court upheld a lower court ruling banning a mother from smoking near her child.
The child is in the custody of her great-grandmother, who'd complained to the court that the girl came home smelling like smoke after visits with her mother. The court decided that no one should smoke around the girl to protect her health.
Some attorneys say smoking is fast becoming a hot-button issue in custody battles.
